THE PET PHOTOGRAPHY MARKETING SYSTEM WORKSHOP

TERMS AND CONDITIONS

1. PARTIES AND ACCEPTANCE

1.1 These Terms and Conditions apply to the purchase of and participation in The Pet Photography Marketing System Workshop and any related recordings, classroom access, resources, templates, prompts, support, bonuses and associated materials supplied by Ina J Photography Pty Ltd ABN 55 678 871 219 of Jerrabomberra, New South Wales 2619, Australia (we, us, our).

1.2 By enrolling in, purchasing, accessing or participating in the Workshop, you agree to be bound by these Terms.

1.3 If you purchase on behalf of a company, partnership, trust or other business entity, you warrant that you have authority to bind that entity to these Terms, and references to you include that entity.

1.4 These Terms apply together with anything expressly stated on the relevant sales page, checkout page and our Privacy Policy. If there is any inconsistency, these Terms prevail to the extent of that inconsistency unless we expressly state otherwise in writing.

2. DEFINITIONS

2.1 Workshop means The Pet Photography Marketing System Workshop, being a hybrid educational and implementation program comprising pre-recorded teaching, live group coaching, resources and limited support.

2.2 Program Start Date means the date of the first live Workshop session for the intake you purchased, unless we notify you otherwise in writing.

2.3 Skool Classroom means the online classroom, portal or community platform nominated by us for Workshop content, recordings, resources and participant interaction.

2.4 Voxer Support Period means the 30-day period starting on the Program Start Date.

2.5 Guarantee Period means the 30-day period commencing on the day after the third live Workshop session ends.

2.6 Qualifying Booking means a new pet photography client booking made by you within the Guarantee Period where:

(a) the booking is for a pet photography service, package or offer priced by you at AUD $1,500 or more;
(b) if you ordinarily invoice in another currency, the booking value must be the reasonable equivalent of at least AUD $1,500 at the date the client pays the initial booking fee, retainer or deposit;
(c) the client was not already booked or contracted with you before the Program Start Date; and
(d) the client has paid a genuine booking fee, retainer, session fee or other upfront payment to secure that booking.

3. WORKSHOP DESCRIPTION AND INCLUSIONS

3.1 The Workshop is designed for pet photographers who have already had paying clients and want to improve their positioning, messaging, campaign strategy and marketing systems.

3.2 Unless otherwise stated on the relevant sales page or checkout page, the Workshop includes:

(a) 3 live online group coaching sessions;
(b) each live session running for at least 75 minutes;
(c) pre-recorded teaching modules released before the relevant live sessions;
(d) access to the Skool Classroom for Workshop recordings and resources;
(e) workbook materials, templates and implementation resources we choose to include;
(f) AI tools, prompts or suggested workflows we choose to include; and
(g) Voxer support during the Voxer Support Period.

3.3 The Workshop may also include an integration or catch-up period between live sessions.

3.4 The Workshop is educational and strategic in nature. It is not a done-for-you marketing service, ad management service, copywriting service, legal service, accounting service or business management service.

3.5 Unless expressly stated otherwise in writing, the Workshop does not include:

(a) unlimited one-to-one coaching;
(b) done-for-you campaign setup or implementation;
(c) legal review of your promotions, ads, email marketing, giveaways, privacy compliance or terms;
(d) paid third-party software, AI subscriptions, ad spend or external service provider costs; or
(e) any guarantee other than the specific continued-support guarantee expressly set out in clause 11.

4. ELIGIBILITY AND SUITABILITY

4.1 You must be at least 18 years old and legally capable of entering into a binding contract.

4.2 The Workshop is intended for photographers who have already had paying clients. It is not designed as a starting-point program for someone who has never had a paying client.

4.3 By enrolling, you represent and warrant that:

(a) you are a genuine operating or emerging photographer in the pet photography market or a closely related niche;
(b) you have previously had at least one paying photography client; and
(c) the Workshop is suitable for your level of experience and intended use.

4.4 We may refuse, cancel or reverse an enrolment if we reasonably believe the Workshop is not suitable for you, your enrolment breaches these Terms, or you fall within the excluded geographic area in clause 5.

5. GEOGRAPHIC EXCLUSION

5.1 The Workshop is not available to photographers who are based in Canberra, ACT, or who operate from within a 150 km radius of Canberra and surrounding regions, unless we approve that enrolment in writing before purchase.

5.2 By enrolling, you warrant that you are not located or operating within that exclusion zone unless you have our prior written approval.

5.3 If you enrol in breach of this clause, we may cancel your enrolment and refund the amount paid by you less any unrecoverable third-party payment processing fees, or take any other reasonable step necessary to protect our legitimate business interests.

6. WORLDWIDE SALES AND LOCAL COMPLIANCE

6.1 The Workshop is sold internationally.

6.2 You are solely responsible for ensuring that any strategy, campaign, giveaway, advertisement, partnership campaign, lead collection process, email marketing, text messaging, landing page, sales process or client-facing material you implement complies with the laws, regulations, platform rules and industry requirements that apply in your own jurisdiction.

6.3 We do not warrant that any campaign structure, giveaway format, promotional strategy, deposit method, partnership arrangement, script, advertisement, email flow or template taught in the Workshop is lawful or suitable in your country, State, Territory, province or local market.

6.4 You must obtain your own legal, tax, advertising, privacy or regulatory advice before implementing any strategy where compliance is uncertain.

7. FEES, PAYMENT AND CURRENCY

7.1 The Workshop fee is the price stated on the relevant checkout page at the time of purchase.

7.2 Unless otherwise stated, Workshop prices are in USD.

7.3 The current Workshop payment options are:

(a) USD $559 pay in full; or
(b) 2 payments of USD $300, with the first payment due at checkout and the second payment due 30 days later.

7.4 Your place is not secured until the required first payment has been successfully processed.

7.5 If you purchase on a payment plan:

(a) you remain liable for the full Workshop fee;
(b) you authorise us and our payment processor to charge each instalment when due;
(c) if an instalment fails, we may suspend access to the Workshop, Skool Classroom, recordings, resources, Voxer support and guarantee rights until your account is brought up to date; and
(d) if payment remains overdue, we may terminate access and recover the unpaid balance.

7.6 You are responsible for any foreign exchange, conversion, bank, card or payment processor fees charged by your financial institution or payment provider.

7.7 Any GST, VAT, sales tax or similar tax applies as required by law.

8. ACCESS PERIOD AND DELIVERY PLATFORMS

8.1 Voxer support starts on the date of the first live Workshop session and continues for 30 days from that date.

8.2 Recordings, templates, prompts, resources and access to the Skool Classroom are provided on an ongoing access basis while the Workshop, the relevant platform and those materials remain active and available in our business.

8.3 We do not promise lifetime, perpetual or permanent access to the Skool Classroom, recordings, prompts, templates or resources.

8.4 We may update, replace, relocate, remove or retire Workshop materials, platforms or access arrangements at any time acting reasonably.

8.5 If we materially discontinue access to core Workshop materials, we will endeavour to provide reasonable notice and, where practicable, a reasonable transition arrangement, replacement access or download opportunity.

8.6 You are responsible for your own internet access, devices, software, email address, Skool access, Zoom access, Voxer access and any other technical requirements reasonably necessary to participate.

8.7 We are not responsible for outages, access issues, delays or functionality failures caused by third-party platforms outside our reasonable control.

9. LIVE SESSIONS, RECORDINGS AND SUPPORT BOUNDARIES

9.1 Live session dates, times and joining details will be notified to you by email, checkout confirmation, Skool Classroom or another nominated channel.

9.2 Session times are scheduled by reference to Sydney, Australia time unless we expressly state otherwise.

9.3 If you cannot attend live, you may watch the recording if a recording is successfully captured and made available.

9.4 We will use reasonable efforts to make recordings available after the relevant live session, but we do not guarantee recording success, upload timing or uninterrupted availability.

9.5 Voxer support is a limited implementation support channel only. It is not unlimited private coaching, emergency support, on-demand consulting or a done-for-you service.

9.6 Unless we state otherwise, Voxer support is provided during our normal business days and business hours only, and we do not guarantee replies on weekends, public holidays or within any fixed response time.

9.7 We may redirect questions to a live session, to Skool, to a group answer or to a later response where that is more appropriate.

10. REFUNDS AND CANCELLATIONS

10.1 Because digital access and Workshop preparation begin on enrolment, refunds are limited.

10.2 If you cancel in writing before the first live Workshop session and before materially accessing the Workshop, you may request a refund.

10.3 For the purpose of clause 10.2, materially accessing the Workshop includes any one or more of the following:

(a) accessing substantial Workshop resources inside the Skool Classroom;
(b) downloading workbook materials, templates or prompts for business use;
(c) watching a substantial part of any Workshop pre-recorded module; or
(d) attending any live Workshop session.

10.4 If you validly cancel under clause 10.2, we may retain a USD $50 administration and digital access fee, and we will cancel any future instalments not yet charged.

10.5 After the first live Workshop session begins, or after material access under clause 10.3, there are no change-of-mind refunds, except as required by law.

10.6 If you are on a payment plan and your refund request is approved under clause 10.2, any future unpaid instalments will be cancelled.

11. WORKSHOP GUARANTEE

11.1 We offer the following conditional result-based continued-support guarantee.

11.2 If you satisfy all of the requirements in clause 11.3 and you do not secure at least one Qualifying Booking during the Guarantee Period, we will continue to provide you with ongoing implementation support inside our then-current Workshop support structure until you secure a Qualifying Booking, subject to these Terms.

11.3 To be eligible for the Workshop Guarantee, you must:

(a) have paid all amounts due under your chosen payment option on time;
(b) attend all 3 live sessions, or if you miss a session, watch the full recording within 5 days after it is made available and before the next live session where reasonably practicable;
(c) complete all core Workshop exercises, worksheets and implementation tasks reasonably directed by us;
(d) complete and launch at least one campaign built from the Workshop within 7 days after the third live session;
(e) actively implement the Workshop in good faith during the Guarantee Period;
(f) use the Voxer support channel appropriately during the Voxer Support Period where you are genuinely stuck, instead of stopping implementation without raising the issue;
(g) submit reasonable evidence of your work, implementation, campaign launch and follow-up if requested by us;
(h) have had at least one paying photography client before enrolment;
(i) not be located within the excluded geographic area in clause 5 unless approved by us in writing before purchase; and
(j) not be in breach of these Terms.

11.4 For the purpose of this clause, ongoing implementation support means support delivered by us in a format we determine acting reasonably, which may include continued access to Workshop materials, periodic group coaching, limited messaging or Voxer support, feedback on implementation, or another substantially similar support format. It does not include unlimited one-to-one coaching, unlimited Voxer access, emergency support, done-for-you services, or support in any format demanded by you.

11.5 You forfeit the Workshop Guarantee if, after the end of the initial Guarantee Period, you:

(a) stop implementing the Workshop for 14 consecutive days without prior written communication;
(b) fail to respond to our reasonable follow-up for 14 consecutive days;
(c) fail to launch, relaunch or continue a campaign or follow-up activity reasonably directed by us;
(d) materially change the strategy taught in the Workshop in a way that may reasonably affect the outcome;
(e) fail to follow up leads, enquiries or prospects in a timely and commercially reasonable manner;
(f) reduce your offer below AUD $1,500 in a way that avoids the stated Workshop promise;
(g) breach these Terms; or
(h) engage in unlawful, abusive or disruptive conduct.

11.6 The Workshop Guarantee is personal, non-transferable and may only be claimed once.

11.7 The Workshop Guarantee provides continued support only. It does not provide a refund, credit or cash payment except where required by law.

11.8 We may modify the format, platform, scheduling and structure of the continued-support component from time to time, provided we continue to provide a reasonable form of implementation support consistent with this clause.

11.9 For clarity, this clause does not exclude or limit any rights you may have under the Australian Consumer Law where those rights cannot lawfully be excluded.

12. NO OTHER GUARANTEE OF RESULTS

12.1 Except for the specific continued-support remedy in clause 11, we do not guarantee that you will achieve any particular result, revenue, enquiry volume, booking number, campaign performance, client quality or business growth outcome.

12.2 Testimonials, examples, case studies and participant results are examples only. They are not promises of what you will achieve.

12.3 Your results depend on factors outside our control, including your pricing, offer, market, positioning, portfolio, lead handling, sales ability, follow-up, consistency and business decisions.

13. PARTICIPANT RESPONSIBILITIES

13.1 You remain solely responsible for your own business decisions, pricing, campaigns, lead handling, contracts, client communications, legal compliance, privacy compliance, tax treatment and implementation.

13.2 You must use the Workshop for lawful purposes only.

13.3 You must not rely on the Workshop as legal, tax, accounting, financial or regulatory advice.

13.4 You acknowledge that Workshop content is educational information only.

14. AI TOOLS, PROMPTS AND THIRD-PARTY SOFTWARE

14.1 We may provide AI prompts, examples, workflows or suggested tools as part of the Workshop.

14.2 Unless expressly stated otherwise, third-party AI platforms, software subscriptions and paid tools are not included in the Workshop fee.

14.3 You are responsible for verifying the suitability, legality, accuracy and quality of any AI-generated content before using it in your business.

14.4 We are not responsible for third-party software outages, policy changes, price changes, account restrictions or inaccurate AI outputs.

15. INTELLECTUAL PROPERTY, NON-USE AND NO REPACKAGING

15.1 All Workshop content, materials and intellectual property remain our property or the property of our licensors, including all recordings, videos, prompts, frameworks, templates, scripts, checklists, exercises, written materials, tools, curriculum structure, training methods and delivery assets.

15.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Workshop materials for your own internal photography business purposes only.

15.3 You must not, without our prior written consent:

(a) copy, reproduce, republish, upload, post, transmit or distribute Workshop materials to another person;
(b) share your login details, Skool access, Voxer access or Workshop recordings;
(c) sell, license, sublicense or commercially exploit Workshop materials;
(d) adapt, package, teach, repurpose or rebrand the Workshop materials into your own education, mentoring, mastermind, course, coaching or consulting offer;
(e) use substantial parts of our materials, frameworks or prompts to create a competing pet photography education offer; or
(f) remove copyright or proprietary notices from any material.

15.4 Clause 15.3 does not stop you from applying general ideas, knowledge, skills or experience learned from the Workshop inside your own photography business.

16. CONFIDENTIALITY AND GROUP ENVIRONMENT

16.1 You must keep confidential any non-public information disclosed by us or by another participant during the Workshop, including business information, pricing, campaign ideas, personal stories, screenshots and strategy discussions.

16.2 The Workshop may involve group participation. While we require respectful treatment of confidential information, we cannot guarantee that other participants will maintain confidentiality, and you disclose information in a group environment at your own risk.

16.3 You must not record, screenshot, distribute or share another participant’s confidential information without their consent.

17. RECORDING CONSENT

17.1 Live sessions may be recorded.

17.2 By attending a live session, you consent to your name, voice, likeness, chat comments, shared screen and contributions being recorded as part of the Workshop recording.

17.3 We may use those recordings for Workshop delivery, participant replay access, quality control, future internal training and related business purposes, unless we expressly agree otherwise in writing.

18. PARTICIPANT CONDUCT

18.1 You must behave respectfully toward us and other participants across all Workshop channels, including Zoom, Skool, Voxer and email.

18.2 You must not engage in abusive, harassing, defamatory, discriminatory, threatening, unlawful or disruptive conduct.

18.3 You must not spam, solicit or market your services to other participants unless expressly invited.

18.4 We may remove, mute, suspend or terminate your access to any Workshop channel if you breach this clause or otherwise create legal, operational or reputational risk.

19. SUSPENSION AND TERMINATION

19.1 We may suspend or terminate your access to the Workshop, Skool Classroom, recordings, resources or support channels if:

(a) you materially breach these Terms;
(b) you fail to pay amounts due;
(c) you misuse Workshop materials or infringe our intellectual property;
(d) you share access with another person; or
(e) your conduct is disruptive, abusive, unlawful or harmful.

19.2 Termination under this clause does not entitle you to a refund, except where required by law.

20. AUSTRALIAN CONSUMER LAW

20.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy you may have under the Competition and Consumer Act 2010 (Cth), Sch 2 (Australian Consumer Law) or any other law that cannot lawfully be excluded, restricted or modified.

20.2 To the extent permitted by law, where liability for breach of a non-excludable guarantee can lawfully be limited, our liability is limited at our option to:

(a) resupplying the relevant services; or
(b) paying the cost of having the services supplied again.

21. LIMITATION OF LIABILITY

21.1 To the maximum extent permitted by law, we exclude liability for any indirect, consequential, special or incidental loss, including loss of profits, loss of revenue, loss of goodwill, business interruption or loss of opportunity.

21.2 To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Workshop is limited to the amount actually paid by you for the Workshop.

21.3 We are not liable for your own acts, omissions, business decisions, client disputes, campaign failures, advertisement performance, third-party platform failures or local regulatory breaches.

22. PRIVACY AND COMMUNICATIONS

22.1 We collect, use and disclose personal information in accordance with our Privacy Policy.

22.2 By enrolling in the Workshop, you consent to receiving administrative, transactional and Workshop-related communications from us by email, Skool, Voxer, text message or other nominated channels.

22.3 You are responsible for keeping your contact details current.

23. GENERAL

23.1 We may update these Terms for future sales at any time.

23.2 The version that applies to your purchase is the version made available to you at the time of purchase.

23.3 If any clause is held invalid or unenforceable, the remaining clauses continue in full force.

23.4 Our failure to enforce a right is not a waiver of that right.

23.5 These Terms constitute the entire agreement between the parties in relation to the Workshop, except for anything expressly incorporated by reference.

24. GOVERNING LAW AND DISPUTES

24.1 These Terms are governed by the laws of New South Wales, Australia.

24.2 The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

24.3 Before starting court proceedings, the parties must first try to resolve any dispute in good faith by written notice and discussion.

24.4 If the dispute is not resolved within 14 days, either party may propose mediation in New South Wales before commencing litigation, except where urgent interlocutory or injunctive relief is required.
